Pattens & Trademarks

For the purpose of the Agreement, intellectual property rights are patents, utility models, rights to inventions, copyright and neighbouring and related rights, moral rights, trademarks and service marks, business names and domain names, rights in get-up and trade dress, goodwill and the right to sue for passing off or unfair competition, rights in designs, rights in computer software, database rights, rights to use, and protect the confidentiality of, confidential information (including know- how and trade secrets) and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, renewals or extensions of, and rights to claim priority from, such rights and all similar or equivalent rights or forms of protection which subsist or will subsist now or in the future in any part of the world (IPRs). 

The IPRs in the Website, in the Service (including the Response) and the copyright in all material stored, displayed and accessible on the Website are either owned by us or duly licensed by third parties. All such rights are reserved. 

BrainChain is a registered trademark, you may not use BrainChain trademark or other BrainChain graphics, logos, page headers, button icons, scripts, and service names in connection with any product or service that is not BrainChain’s, in any manner that is likely to cause confusion as to the origin of the Service, or in any manner that disparages or discredits BrainChain. All other trademarks not owned by BrainChain that may appear on the Website or in the Service are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by BrainChain. 

No Endorsement or Sponsorship: BrainChain  does not support the use of its logos, company names, product names, or images of BrainChain products by other parties in marketing, promotional or advertising materials as their use may create the perception that BrainChain  endorses or sponsors the product, service or promotion.

Trade Dress. You may not imitate the trade dress or “look and feel” of any of our web sites or pages contained in any of our web sites, including without limitation, the branding, color combinations, fonts, graphic designs, product icons or other elements associated with us.

Slogans and Taglines: You may not use or imitate an BrainChain slogan or tagline.
For example: “Pro Omnium Virtute”

Domain Names: You may not use an identical or virtually identical BrainChain trademark as a second level domain name.
E.g. Not acceptable: mybrainchain.org
